Terms of Service

By creating an account, accessing, or using the FCR platform, you fully accept these Terms of Service, our Privacy Policy, and any additional policies referenced in this document.

These terms constitute a legally binding agreement between you (or the organization you represent) and Agrobyte. If you are accepting on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

We reserve the right to modify these terms at any time. Significant changes will be communicated with a minimum of 30 days' notice. Continued use of the platform after notification constitutes acceptance of the changes.

The FCR platform offers tools for collecting, managing, analyzing, and visualizing field data in agricultural operations, including geolocation features, report generation, team management, and communication.

Services are provided "as is" and "as available." We continuously work to maintain high availability but do not guarantee that the platform will be free from interruptions, errors, or temporary failures.

We may add, modify, or discontinue platform features at any time, with prior communication to affected users when possible.

To access the platform, you must create an account by providing accurate and up-to-date information. You are responsible for maintaining the confidentiality of your access credentials.

Each account is personal and non-transferable. You must not share your credentials with third parties. Any activity carried out through your account is your responsibility.

You must notify Agrobyte immediately in case of unauthorized use of your account or any security breach. We will not be liable for losses resulting from unauthorized use of your account.

You agree to use the platform only for legitimate purposes and in compliance with all applicable laws and regulations, including the LGPD and other data protection standards.

It is expressly prohibited to: use the platform for illegal or unauthorized purposes; attempt to access restricted areas of the system; reverse engineer, decompile, or disassemble any part of the platform.

It is also prohibited to: transmit viruses, malware, or malicious code; interfere with platform operation or overload our servers; collect data from other users without authorization.

The FCR platform, including its source code, design, interfaces, logos, trademarks, and all original content, is the exclusive property of Agrobyte and is protected by intellectual property laws.

The license granted to the user is limited, non-exclusive, non-transferable, and revocable, restricted to use of the platform according to these terms. No intellectual property rights are transferred to the user.

Data entered by the user on the platform remains the property of the user or the contracting organization. Agrobyte does not claim ownership of field data collected through the platform.

To the maximum extent permitted by law, Agrobyte shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or goodwill.

Our total liability in any claim related to the services shall be limited to the amount paid by the user in the 12 months preceding the event giving rise to the claim.

We are not responsible for decisions made based on data or analyses provided by the platform. The user is solely responsible for the interpretation and application of generated insights.

You may terminate your account at any time by contacting our support. After termination, your access to the platform will be deactivated and your data will be handled according to our Privacy Policy.

Agrobyte may suspend or terminate your account immediately, without prior notice, in case of violation of these terms, fraudulent activity, or legal requirement.

After termination, provisions that by their nature should survive termination will remain in effect, including intellectual property, limitation of liability, and general provisions.

These Terms of Service are governed by the laws of the Federative Republic of Brazil. Any dispute shall be submitted to the jurisdiction of the courts of Sao Paulo/SP, waiving any other, however privileged.

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Agrobyte's failure to exercise any right provided in these terms does not constitute a waiver of that right. These terms constitute the entire agreement between the parties regarding the use of the platform.
